These terms govern your use of this Website. They do not govern paid client engagements with Zevi Digital. When you retain us for marketing services, that relationship is governed by a separate written services agreement, and where we handle patient health information for a practice, by a Business Associate Agreement and HIPAA. If anything in those agreements conflicts with these Website terms, the signed agreement controls.
1. Acceptance of Terms
By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree to all of its terms, you are not authorized to use the Services.
2. Changes to These Terms
We may update or modify this Agreement at any time. When we do, we will revise the "Last updated" date above and post the new version on this page. Your continued use of the Services after changes are posted means you accept them. We encourage you to review this page periodically.
3. Use of the Services
You agree to use the Services only for lawful purposes and in accordance with this Agreement. You agree not to use the Services:
- In any way that violates an applicable law or regulation.
- To exploit, harm, or threaten others.
- To transmit, or arrange the transmission of, any material that is harmful, offensive, obscene, or otherwise objectionable.

The Z-PAP™ system and the Zevi Digital name and marks are ours. You are granted a limited, non-exclusive, non-transferable license to access and use the Website in accordance with this Agreement. You may not copy, reproduce, or republish our content without our written permission.
5. User Content
If you submit content to us through the Website, such as a message, review, or file (your "User Content"), you grant Zevi Digital a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for the purpose of operating and promoting our business. ZEVI DIGITAL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ZEVI DIGITAL MAKES NO REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR RESULTS OF USING THE SERVICES.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZEVI DIGITAL WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ZEVI DIGITAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification
You agree to indemnify and hold harmless Zevi Digital and its team from any claims, losses, or expenses, including reasonable attorney fees, arising out of your use of the Services or your violation of this Agreement.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and without notice. The sections of this Agreement that by their nature should survive termination will survive.
12. Governing Law and Venue
This Agreement is governed by the laws of the State of California, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to this Agreement or the Services will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
13. Entire Agreement
This Agreement is the entire agreement between you and Zevi Digital regarding your use of the Services, and it supersedes any prior agreements on that subject. If any provision is found unenforceable, the rest of the Agreement remains in effect.
